Special Meeting Minutes

 

A.    Preliminary Business

Roll Call

The special meeting of the Washington State Executive Ethics Board (Board) was called to order by Chair Shirley Battan via GoToMeeting at 1:02 p.m.  In attendance were Vice Chair Gerri Davis and Members Lisa Marsh, Anna Dudek Ross and Jan Jutte. Board staff in attendance included:  Executive Director Kate Reynolds, Assistant Attorney General Michelle Carr, Assistant Attorney General Chad Standifer, Senior Investigator David Killeen, Investigator Bobby Frye and Administrative Officer Ruthann Bryant.

 

B.    Closed Session

At 1:04 p.m. the Board moved into Closed Session to deliberate on quasi-judicial matters. 

At approximately 1:51 p.m. the Board returned to regular session.

 

Motion 20-078 Moved by Chair Battan, seconded by Member Jutte:

 

The Board recinds the Reasonable Cause over $500 as well as the added violations of RCW 42.52.070 and RCW 42.52.160 in EEB Case 2020-042 Roger Millar.

 

Motion 20-079 Moved by Member Marsh:

 

The Board finds Reasonable Cause for RCW 42.52.180 in EEB Case 2020-042 Roger Millar as well as the added violations of RCW 42.52.070 and RCW 42.52.160. Mr. Millar will be issued a Letter of Instruction for providing his personal political views in an email and for using an all staff email list that others do not have access to.

 

Motion 20-079 dies for lack of a second.

 

Voting For Motion 20-078:  Chair Battan, Vice Chair Davis, and Members Dudek Ross and Jutte.

 

Voting Against Motion 20-078:  Member Marsh.

 

Motion 20-078 passed.

 

Motion 20-080 Moved by Chair Battan, seconded by Vice Chair Davis:

 

The Board determined that any violation that may have occurred does not constitute a material violation because it was inadvertent and minor, or has been cured, and further proceedings would not serve the purposes of this chapter in EEB Case 2020-042 Roger Millar.

 

Motion 20-081 Moved by Member Marsh:

 

The Board finds Reasonable Cause for RCW 42.52.180 in EEB Case 2020-042 Roger Millar as well as the added violations of RCW 42.52.070 and RCW 42.52.160. Mr. Millar will be issued a Letter of Instruction for providing his personal political views in an email and for using an all staff email list that others do not have access to.

Voting For Motion 20-080:  Chair Battan, Vice Chair Davis, and Members Dudek Ross and Jutte.
